I applied for Labor in EB2 category in Oct 2007. It was pending for 2 yrs and 2 days back my employer mentioned that they see my Labor status as denied and that they have not received any denial letter yet.
My H1 will expire in early Jan 2011, so I practically have around 365 days from now to apply for a new Labor. My questions are
1. Should I re-appeal?
2. Do Labors get approved in re-appeal?
3. Can I start a new Labor application with the same employer simultaneously?
4. What�s a safe category to apply at this point in time. EB2 or EB3?

Am in a strange situation
I filed I-140 and I-485 together in Aug 2007. I got I-140 receipt waiting for I-485 receipt.

Can I work in UK or Canada for some time?

My wife is on a H4 visa. Her visa is going to expire june 2010... she has to go to India later this month on a very urgent work....
So is it advisable to go considering the scrutiny at port of entry nowadays ???

Yes she can go as she has valid visa to come back. Let her carry your approval notice, recent employement letter and recent pay stub ... just in case they ask at POE. I don't think you should lose sleep over it. So what if there is additional scrutiny? If she hasn't done any wrong she should be alright.

I filed for 485 went to India came back to USA. I didn't have any 485 receipts with me.
Had no issues what so ever, in fact I was not asked anything about 485 application. After coming back went for finger printing , that means my application is still in process.
Important Note :- During this period I had valid H1b stamp on my passport.

If you satisfy all conditions of AC-21, then nothing happens to your AOS:
- your i-140 is approved
- 180 days have passed since your filing of 485
- new jobs is same/similar to old one

Assuming rest of AC-21 requirements are met, if hte new job is not deemed similar to old one by USCIS when they adjudicate your 485, it can result in a denial.

My PD is current since I filed the case, after waiting for almost 8 months I opened the S.R and got the letter back explaining...."We are actively working on your case, however your case under extended background check…blah..blah..blah…"

If you just want MultiScaleImage content to display without a web server, you can do that today itself! That is what Deep Zoom Composer does. The only challenge comes from loading external XML content such as the XML file used for filtering :)

2. I understand that one can file amendment before or within 180 days of acceptance of 485. is this correct ?
3. Is there anyway to know that I am nearing my acceptance of 485?

I gues with iin 2 months for AP. but i don't know in current scenario with lot of applications. There is no harm in filing AP & EAD with 485. Even if you get them you can use it or not choice is yours. but if you use EAD h1/H4 will be invalid and you have to come back in AP. Also if you come in AP then your H1/h4 will be invalid you have to use EAD.
I think 4-5 months is decent time to get AP. But with current volume I am not sure.
I don't think traveling back on AP invalids your H1. I checked with my lawyer and this is what he told me.

You need the reference. Go to the solution window (located on the right side and right click on it and select add reference). Empty project is just that, empty.
Console applications are normally the non-GUI projects. It will default and add certain references.
Just for some future information you can create class library for creating a dll with a project. Useful if you are using certain code in multiple solutions. In this way instead of including the files you just include the project and in the solution put a reference to the project and it includes the .dll (dynamic link library) file when building the solution.

the question is how can i file my own 485 when i don't have details about I140. Is there a way where by i can get this info. i need SRC number to file for my 485 and i am current. i am on EB2 , other country not India, China .

I was scheduled to go to an I485 interview(PD: March 2006) at the end of this month.
Here is my situtation, my H1B was expired at 08/15/09 and I renewed my expired EAD(expired in January, 2009) on 07/30/2009. However my previous employee laid me off on 08/31/09. Before I got my new EAD on 11/18/09 and started my new job on 11/23/09, there was a period of time(from 09/01/09 to 11/22/09) that I was umemployed without a valid H1B or EAD.
Is that a big deal when I go to the interview? If it is, does anyone want to provide any advice?

I opened a service request with USCIS when my I485 was current in 09/08 and i got response saying that still investigation into my background remains open, so the case is not yet ready for decision. I filed my I 485 in August 2005 and in july 2007(then my file was current) also i was told that the background check is still going on.
Now we know that if it has been more than 180 days after we file I485, no need to wait for background check to process the petetion. My intention is to get my file out of this loop by the time PD becomes current. If any one had this issue and got it resolved, please advise me how i can handle it.
