If she does COS to H4 now (June 2008) and if she plans to COS to H1 next year (Lets say March 2009), then will her new H1 application still be considered against the H1B cap (cos her first h1b must have expired in Oct 2008)?

Currently there are a lot of RFE's and renewal denials when they try to renew onsite. So they have been asked to go back to get renewed and once its successful, they come back. They are just being cautious.

Dumb rookie questions are more fun than Pro' questions in my opinion. Mostly because I'm able to answer them...
Although I enjoy motorcycles, I'm not really a BMW fan (just don't really fancy them, nothing in particular, just not my type of bike... More of a japanese race-bike type of guy).
Guitarrs tend to not work at all for me... :-(
But I'm happy to answer any questions you may have - assuming I know the answer, or am able to figure out something that sounds realistic ;-)

I do not have the URL to the USCIS document but know for sure that this requirement has been discontinued from Nov 2007.

Please while protesting, Try to position yourself in ways where the society will accept you. I took sociology and learnt a great deal and I feel minorities need to find a common ground and establish themselves with a new society. Please do not make them detest us or bully us in anyway. There is a business visa (B1) he can apply. If he applies for the B2 (tourism visa) and tries to work, it will be illegal. He beeds to say "business" in the purpose of the visit column.

My H1-B is expiring in December 2007. I have approved I-140 now and am hoping to get 3 year H1-B extension based on my approved I-140. Do you think I can get 3 year extension even if the visa numbers for filing AOS is current? Does AC21 apply to this case? Please suggest.

Canada has been using this for skilled worker program, where individuals can apply for Canadian permanent residency independently if they fullfill the passmark. Other countries like Australia, UK and New Zealand also follow suit with different types of difficulties.

It is a case to sign in native language...
Well, if you forgot to fill the native language thing but signed the form, you don't have to worry about anything. Although the form is incomplete, the officer has no way of knowing for sure that your native alphabet is other than English... You may or may not get an RFE on this later...

Why was my question not taken up?
The following is a list of probable reasons why certain questions may not have been accepted. This list, is of course, not exhaustive.

- lack of clarity in the law on specific situations
- incomplete
- too generic
- frivioulous
- no previous incidence that the attorney can draw upon without significant research(new situation)

We also request members to not send emails from corporate email accounts. It is IV's policy to refrain as much as possible from sending email to members that may constitute as spam.
