I am planning to use AC21 and notify USCIS about it. I have the labor job title, code and salary. The salary applied was in hourly rate of $46. So at the new permanent job, I have it as annual salary.

So how much would $46 be in annual salary or should I just have an hourly rate on my experience letter from my new employer.

In delhi consulate when I click on Indian resident I see the available dates but when I click on Indian citizen residing in US, I see no availability. I'm not sure which option should I choose. I'm a student working on OPT in US. My OPT will expire on Aug 4th and so I will come to India. I'm not sure which of the two options I have to choose while scheduling an interview :

Resident of India/Bhutan
OR
Indian Citizen residing in United States.


I would really appreciate any help in this matter.

I am in the same situation...my 6th yr H1 expires on Feb 2008. I am really hoping that I will get an EAD before my H1 expiration. But if I dont get an EAD on time then I will apply for recapturing my time outside USA. I travel overseas a lot on business so basically i will need about 3months of time recaptured to meet the 1 yr prior labor approval for H1 extension. My PD is april 2007. Hope this helps and works out for you.

BTW..i recieved my receipt notices for EAD,485 and AP last week.

I have to renew my passport since it is expiring next month.

What is the specification for the passport photo? It it 2inch x 2inch or
is it 3.5cm by 3.5cm
I was preparing to use the same as that of GC process, 2inch x 2inch
but now I need to check this out...

DOES ANYONE KNOW IF WE NEED TO TAKE A PREPAID POSTAGE ENVELOPE ? even if u attending in person..

Its quite likely that we may get some quick relief on alternate vehicles (bills) for minor things like the ability to apply I485 when the visa is not current. We should not count that out ... Not sure what boat you are in but I am waiting for applying my I485.

Hi

I have valid AP until Oct 16, 2008. I am going out of country between 1st Aug - 31 Aug.

I read that upon return, I will be paroled for validity with 1 year from that date.. i.e 31 Aug, 2009.

Does that mean I will not need AP renewal until 31 Aug, 2009 and I can re-enter US until that date without having to renew AP.?

I asked my company attoreny about this.. he said that immigration petition is I-140 and as I-140 is not filed for your wife (I-485 is already filed for my wife) so I should say No there for my wife's form.

You are right , I just got the same information from my employer and the attorney that I-140 is the visa petition and not the I-485.So for H4 dependents the answer should be "NO"

I am in the exact same situation. I have already filed I-140/I-485 concurrently with the substituted labor. Now the dates are current I am filling another I-485 with my approved I-140. There is nothing wrong in what we are doing, as long we explain about the earlier filling and clarify the motive of the second filling. Eventually we should withdraw one of the two based on the outcome of substituted labor/I-140.

I submitted an AR-11 (address change) form on 3/13/2008. The LUD changed the next day to 3/14/2008.

However, the LUD changed again yesterday to 3/17/2008. Has anyone had experience with AR-11 and LUD updates. If so, please share if multiple LUD updates are the norm for AR-11 changes....
